Interact electronically with the Administration

Internet Portals and Electronic Offices

Generally, we can distinguish between two types of websites through which you can relate electronically with the Public Administrations. What are the differences? :

  • Internet portal. It is the electronic access point through which you can access, through the Internet, the information published by a Public Administration or public agency.
    It also allows you to access the corresponding electronic headquarters.

  • Electronic headquarters. It is the Internet address through which you can carry out the procedures corresponding to a public administration or agency. The electronic seats are the equivalent of the physical seats where the citizenship is directed to make a procedure.

Do I have an obligation to interact electronically with the Administration?

You have the right to interact electronically with the Public Administrations, and to be able to choose at any time whether you communicate with the Public Administrations for the exercise of your rights and obligations through electronic means or not.

But there are certain people or certain cases in which you have the obligation to relate electronically.

These assumptions are established in the Article 14 of Law 39/2015 (for example, legal persons).

In addition, the Public Administration may regulate the obligation for certain natural persons in certain procedures. For example, people who oppose the Corps of the General Administration of the State are obligated people, according to the first additional provision of Royal Decree 203/2021.

Am I entitled to assistance in the use of electronic media?

There are people who are not accustomed to the use of technologies and who may have difficulties when carrying out some procedure electronically with the public administration.

For example, older people, those who do not have adequate technological resources, or people with disabilities.

You will be provided with special assistance in terms of identification and electronic signature, the submission of applications through electronic registration and the obtaining of authentic copies.

There are two types of assistance in the use of electronic media:

  • General. It is about guiding and helping people in the use of electronic media. It is done through the different support channels, as set out in the Article 4 of RD 203/2021.
    Everyone is entitled to this type of general assistance.
  • Specific. In this case, an official performs the administrative action on your behalf. This is “assistance through an authorized official.” You only have the right if you are not a person obliged to relate electronically with the Administration.

Regulatory regulation

The operation and operation of the public sector by electronic means are regulated in the Regulation implementation and operation of the public sector by electronic means, in development of laws 39/2015 and 40/2015.
