Constitutional Court

It is a separate and distinct institution from the others.

Its function is to guarantee the supremacy of the Constitution and its observance by all public authorities. Their tasks are:

  • Control of the constitutionality of international treaties and laws.
  • Resolving conflicts of competences between the central institutions of the State (legislative, executive, judicial); Resolving conflicts of competences between the State and the Autonomous Communities (regions).
  • Preserving the autonomy of local authorities and ultimately safeguarding the fundamental rights of citizens.

Its relations with the other powers are reflected in the appointment of its members. The Government, the General Courts - by very large majorities - and the General Council of the Judiciary propose the appointment of its 12 members. The King appoints them for a period of 9 years. In this way, their democratic legitimacy and independence in the exercise of their functions are guaranteed.
