as set forth in the Article 56.1 of the Spanish Constitution, The King is the Head of State, a symbol of its unity and permanence, arbitrates and moderates the regular functioning of the institutions, assumes the highest representation of the Spanish State in international relations, especially with the nations of its historical community, and exercises the functions expressly attributed to it by the Constitution and laws.
According to the Constitution, as a symbol of state unity, it is up to the King to intervene in important acts of the State:
- Appointments of the President and Judges of the Constitutional Court (arts. 159 and 160);
- Enactment and promulgation of laws (art. 62 (a));
- Issuance of decrees agreed at the Council of Ministers (Article 62 (f));
- Appointment of the President and members of the Government (articles 99.3 and 100).
- Appointment of the President of the Supreme Court (Article 123.2);
- Appointment of the Presidents of the Governing Councils of the Autonomous Communities (Article 152.1).
It is also up to the King:
- The high patronage of the Royal Academies (article 62 j).
- Conferring civil and military jobs, as well as granting honours and distinctions (art. 62 (f));
- Supreme command of the Armed Forces (art. 62 (h));
- Exercise of the right of pardon (art. 62 (i));
As arbitrator and moderator of the regular functioning of the institutions, corresponds to the King: :
- The convening and dissolution of the Courts and the convening of elections (art. 62 (b));
- The call for a referendum (art. 62 (c));
- The proposal of the candidate for President of the Government (art. 62 (d));
- To be informed of State affairs and to chair, for this purpose, the meetings of the Council of Ministers (Article 62 g).
As the highest representative of the Spanish State in international relations, corresponds to the King:
- Accredit ambassadors and other diplomatic representatives, express the consent of the State in treaties, and declare war and make peace (article 63).
In accordance with the provisions of the corresponding laws, the King is responsible for Appointment of the following authorities:
- President of the Court of Auditors (Article 29 of Organic Law 2/1982, of 12 May, of the Court of Auditors).
- Attorney General of the State (article 29.1 of Law 50/1981, of 30 December, regulating the Organic Statute of the Public Prosecutor).
- Governor of the Bank of Spain (article 24.1 of Law 13/1994, of 1 June, on the Autonomy of the Bank of Spain).
Prestan oath or promise to the King:
President and members of the Government.
Judges of the Constitutional Court (article 21 of Organic Law 2/1979, of 3 October, of the Constitutional Court).
President and Members of the General Council of the Judiciary (articles 123.4 and 115 of Organic Law 6/1985, of 1 July, on the Judiciary).
President of the Court of Auditors (article 21.6 of Law 7/1988, of 5 April, on the Functioning of the Court of Auditors).
Attorney General of the State (article 29.3 of Law 50/1981, of 30 December, regulating the Organic Statute of the Public Prosecutor).
Governor of the Bank of Spain.
