Calendars of non-working days

What is the calendar of non-working days

In the calendar of non-working days These include the days that are considered unskilled for the purpose of calculating deadlines in the performance of administrative actions and for the exercise of the rights of citizens before the Public Administration.

Calendars of non-working days of the General Administration of the State (AGE)

The calendar of non-working days (to be taken into account for the purpose of calculating deadlines) is fixed by each Administration annually And it must be published for the knowledge of all citizens before the beginning of each year.

Its publication is made in the corresponding official journal and in other media that guarantee its knowledge.

The calendar of non-working days is prepared subject to the official working calendar, setting in its respective scope (state, regional and local administration) the non-working days (Art. 30.7 of Law 39/2015, 1 October, on the Common Administrative Procedure of Public Administrations).

The work schedule is published by the Ministry of Labour, Migration and Social Security, in compliance with the provisions of the Act. Royal Decree 2001/1983, on the regulation of working hours, special days and breaks.

Therefore, in general, these will be unworking days:

  • Every Saturday and Sunday
  • Certain religious festivals established throughout the National Eremu, such as: 15 August; 1 November; 8 December; 6 January
  • Nation-wide festivities recognized in the Workers' Statute: 1 January; 1 May; 12 October; 25 December
  • Festivals of a civic nature: 6 December
  • Festivities of a civic and religious nature of the Autonomous Communities and Local Entities

The calendar of non-working days within the General State Administration is published by the Ministry for Digital Transformation and the Civil Service, through the Secretariat of State for the Civil Service, in the Official State Gazette (BOE), before the beginning of each year, as well as in other media that guarantee its widespread knowledge.

The administrative actions and the exercise of the rights of citizens before the Administration must be carried out within the time - deadlines and terms - that are indicated for them. This rule equally obliges the authorities and personnel at the service of the competent Public Administrations for the processing of administrative matters and those interested in them.

The “term” refers to the specific moment in time when the rule requires an act to be performed, for example, the appearance in a public office at a specific time.

The “time limit” consists of a period of time, more or less wide, established in the norm to carry out an action, for example, the 10-day period of correction granted in a request.

The actions carried out "out of time" may have repercussions both on the acts - an appeal filed after the deadline will be the subject of an inadmissibility decision - and on the personnel in the service of the Administration who is in charge of the dispatch of the cases - has the legal obligation to issue an express ruling within the deadline, being able the breach of said obligation to give rise to the requirement of disciplinary responsibility, without prejudice to the one that has occurred according to the applicable regulations -.

The calculation of deadlines in the administrative processing has a certain complexity because different elements have to be taken into account:

  • the extent to which the time limit is given (hours, days, months or years)
  • the day the period begins to be counted (initial day-dies a quo-)
  • The day on which the deadline ends (end day -díes ad quem-)

Articles 30 and 31 of the LPAC (Law 39/2015, of 1 October) They establish the legal regime applicable to the computation of deadlines.

The system of computation in the processing of administrative procedures depending on whether they are indicated in hours, days, months or years It is as follows:

  • If the deadlines are indicated in hours: unless otherwise provided by law or in European Union law, it is understood that these are skilful. Every hour of the day that is part of a business day is skillful. Time limits expressed in hours shall be counted from hour to hour and from minute to minute from the hour and minute at which the notification or publication of the act in question takes place and shall not exceed twenty-four hours, in which case they shall be expressed in days.
  • If the deadlines are indicated in days: provided that by law or in European Union law no other computation is expressed, it is understood that these are skillful, excluding Saturdays, Sundays and those declared festive from the computation. When deadlines are indicated by calendar days, this circumstance will be recorded in the corresponding notifications. The time limits expressed in days shall be counted from the day following the day on which the notification or publication of the act in question takes place or from the day following the day on which the estimate or the rejection by administrative silence takes place.
  • If the time limit is fixed in months or years: these shall be calculated from the day following the day on which the notification or publication of the act in question takes place, or from the day following the day on which the estimate or rejection is made by administrative silence. The period shall end on the same day as the notification, publication or adminsitrative silence occurred in the month or year of expiration. If in the month of expiration there was no day equivalent to that in which the computation begins, it will be understood that the term expires on the last day of the month.

Where the last day of the period is unreliable, it shall be deemed to have been extended to the following first working day .

In addition, when one day it was skilful in the Municipality or Autonomous Community in which the interested party resided, and unskillful in the headquarters of the administrative body, or vice versa, it will be considered unskillful in any case.

The declaration of a day as being able or unable for the purposes of calculating deadlines does not in itself determine the functioning of the work centres of the Public Administrations, the organization of working time or the schedule and working hours of the same.

For its part, article 31 of the same Law establishes the regime applicable to the calculation of time limits in the Registries.

Each Public Administration will publish the days and times in which the offices that will provide assistance for the electronic presentation of documents must remain open, guaranteeing the right of the interested parties to be assisted in the use of electronic means.

The electronic registration of each Administration or Agency shall be governed for the purposes of calculating the deadlines, by the official date and time of the electronic office of access, which must have the necessary security measures to guarantee its integrity and appear in an accessible and visible way.

The operation of the electronic register will be governed by the following rules:

a) It will allow the presentation of documents every day of the year during the twenty-four hours.
(b) For the purposes of calculating the time limit fixed in working days, and with regard to the fulfilment of time limits by the interested parties, the presentation on an unsuitable day shall be understood to be made in the first hour of the first following working day unless a rule expressly allows the reception on an unsuitable day.
The documents will be considered presented by the effective order of time in which they were presented on the unskillful day. The documents presented on the unskilled day shall be deemed earlier, in the same order, than those presented on the first subsequent working day.
c) The start of the calculation of the deadlines to be met by the Public Administrations will be determined by the date and time of presentation in the electronic register of each Administration or Agency. In any case, the effective date and time of start of the calculation of deadlines must be communicated to the person who presented the document.

The electronic office of the registry of each Public Administration or Agency shall determine, in accordance with the territorial scope in which the holder of the registry exercises its powers and the timetable provided for in Article 30.7, the days that shall be considered unsuitable for the purposes provided for in this Article. This shall be the only calendar of non-working days to be applied for the purposes of calculating time limits in electronic records, without applying to them the provisions of Article 30.6.

The established time limits may be extended, unless otherwise stipulated - for example, the time limits for are not applicable - either ex officio or at the request of the interested parties, for a period not exceeding half of them, if the circumstances so warrant and thus do not prejudice the rights of third parties. The extension agreement will be notified to the interested parties

In any case, the extension of the deadlines will apply to the procedures processed by diplomatic missions and consular offices, as well as to those that, proceeding in the interior, require to complete some procedure abroad or in which interested parties resident outside Spain intervene. However, in no case may an expired period be extended. Both the request of the interested parties and the decision on enlargement must, in any case, take place before the deadline in question. Agreements on the extension of time limits or on their refusal shall not be subject to appeal, without prejudice to the right to appeal against the decision terminating the proceedings.

When a technical incident has made it impossible for the corresponding system or application to function normally, and until the problem is solved, the Administration may determine an extension of the unexpired deadlines, having to publish in the electronic headquarters both the technical incident that occurred and the specific extension of the unexpired deadlines.
