Deadlines for the submission of tenders

Contracting authorities will establish deadlines for the submission of tenders and requests to participate, taking into account the time which may reasonably be required for drawing up tenders, based on the complexity of the contract, and in accordance with the minimum periods established by law.

In open contract award procedures subject to harmonised rules, the time limit for submitting proposals must be no less than 35 days for works, supply and service contracts and 30 days for works and service concessions.

For contracts not subject to harmonised rules, the time limit must be no less than 15 days. In the case of contracts for works, works concessions and service concessions, the time limit must be at least 26 days.

In the simplified open procedure, the time limit may not be less than 15 days. For works contracts the time limit must be at least 20 days. In the super-simplified open procedure, the time limit may not be less than 10 working days. In the case of purchases of commonly used goods available on the market, the time limit is 5 working days.

In the restricted procedure for contracts subject to harmonised rules, the time limit for submitting requests to participate may be no less than 30 days. In the case of contracts not subject to harmonised rules, the time limit must be no less than 10 days.

In the competitive procedure with negotiation and the competitive dialogue procedure, the time limits are the same as in the restricted procedure.

In the innovation partnership procedure, the minimum time limit for the receipt of requests to participate is 30 days, if the contract is subject to harmonised rules. If it is not, the minimum time limit may not be less than 20 days.

Documentation to be provided

In the open procedure, proposals must be accompanied by an undertaking of compliance with the European Single Procurement Document (ESPD) form (except in the simplified open procedure, in which the ESPD is not required), which must be signed and include the relevant identification, in which the tenderer:

  1. Shows that the company is validly incorporated, that in accordance with its objects it can submit the tender and that the signatory has capacity as its representative.
  2. Demonstrates that it has the relevant classification, where appropriate, or that it fulfils the economic, financial and technical or professional standing requirements.
  3. Establishes that it is not excluded from procurement procedures.
  4. Designates, for the service of documents, an email address which must be ‘authorised’.

In the case of restricted procedures, competitive procedures with negotiation, competitive dialogues and innovation partnerships, the undertaking of compliance will additionally show that the objective requirements established in line with the standard form of the European Single Procurement Document (ESPD) have been fulfilled.
