Since 25 October 1998, the special schemes for public servants in Spain have come under the scope of European Union regulations, with a view to the coordination of social security systems.
Those currently in force are Regulation No 883/2004 on the coordination of social security systems and Regulation No 987/2009, which implements the coordination regulation.
Because the schemes come under the scope of the above regulations, it is possible, both for the purpose of recognising entitlement and for the purpose of calculating any pensions payable under the public servants’ pension scheme, to take into account contribution periods and periods treated as such completed under the applicable legislation of other Member States of the European Union or of the European Economic Area, Switzerland or the United Kingdom of Great Britain and Northern Ireland.
This means that, when applying for a pension under the public servants’ pension scheme, you must take into account and provide information concerning contribution periods in any of the countries mentioned above.
What requirements must I meet?
The requirements for entitlement to a pension are those generally applicable to each type of pension, with the particular feature that contribution periods and periods treated as such completed in those countries will be taken into account both for the purpose of recognising entitlement and for calculating the corresponding pension.
What am I entitled to?
Pensions will be calculated in accordance with the specific rules for each of type of pension, taking into account as actual years of service any contribution periods and periods treated as such completed in the countries referred to.
However, these periods are taken into account with a pro-rata percentage is applied, based on the relationship between the number of days covered in Spain and the total number of insured days (in and outside of Spain). This percentage will be applied to the theoretical pension obtained by including periods of contribution in other countries.
The resulting pension will be divided by 14 to obtain the monthly pension payment.
How do I apply for it?
The procedure for recognition of a retirement pension is initiated at the request of the person concerned. Applications are available at the following link . Those applications must be sent to the Subdirectorate-General for the Management of Public Servants’ Pensions if you reside in Spain. If you reside in another Member State, you must initiate the procedure before the relevant authority in your country of residence.
